1. Acceptance of Terms

By accessing or using the mistaike.ai platform, website, API, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

The Service is not intended for use by persons under the age of 18. If you are entering into these Terms on behalf of a company, business, or other legal entity, you represent that you have the authority to bind such entity to these Terms, and the word "you" refers to that entity.

These Terms govern your contractual relationship with mistaike.ai. For full details of how we process your personal data and your rights under the UK General Data Protection Regulation (UK GDPR), please refer to our Privacy Policy, which is incorporated by reference into these Terms and forms part of the entire agreement between you and mistaike.ai.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and mistaike.ai regarding the Service and supersede all prior agreements and understandings.

2. Service Description

mistaike.ai provides an AI-powered database of coding mistakes, bug-fix patterns, and related technical insights. The Service includes:

- A web UI for searching and browsing the pattern database

- An Application Programming Interface (API) for programmatic access

- A Model Context Protocol (MCP) server endpoint for integration with AI assistants

- A Vault feature for encrypted personal secret storage (see Section 7)

We reserve the right to modify, add, or remove Service features. For paid subscribers, we will provide at least 30 days' written notice of any change that materially reduces the core functionality you subscribed to. If you consider such a change materially detrimental, you may cancel your subscription and receive a pro-rata refund of unused prepaid subscription fees. In urgent circumstances (security threats, legal obligations), changes may take effect with shorter or no notice.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

- Provide accurate, current, and complete information during registration and keep it updated

- Maintain the confidentiality of your account credentials, including passwords and TOTP (Time-based One-Time Password) secrets

- Notify us immediately of any unauthorised use of your account at [email protected]

- Maintain only one active account per individual user

You are solely responsible for all activity that occurs under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

- Engage in automated scraping, crawling, or bulk data extraction beyond the permitted API usage described in Section 8

- Reverse engineer, decompile, or disassemble any part of the Service

- Attempt to circumvent rate limits, access controls, or security measures

- Use the Service to transmit malicious code, malware, or unlawful content

- Use the Service in any way that could disable, overburden, damage, or impair the platform or interfere with other users

- Impersonate any person or entity or misrepresent your affiliation with any person or entity

- Use the Service for any purpose that is unlawful or prohibited by these Terms

5. Intellectual Property

5.1 Platform IP

mistaike.ai retains all rights, title, and interest in and to the platform, the compiled pattern database, the underlying software, and all related intellectual property. Nothing in these Terms transfers any ownership of platform IP to you.

5.2 Submitted Content

Where you submit your own bug patterns or other content to the Service ("Submitted Content"), you retain any copyright you hold in that content.

By submitting content, you grant mistaike.ai a royalty-free, worldwide, non-exclusive licence to use, display, store, reproduce, modify, adapt, and sublicence (to service providers necessary to operate the Service) your Submitted Content for the purpose of operating, improving, and promoting the Service. This licence:

- Remains in effect for so long as your content remains in the mistaike.ai database

- Does not transfer ownership of your content to mistaike.ai

- Is terminable by you at any time by submitting a valid erasure request to [email protected]

This licence is expressly designed to be compatible with your right to erasure under Article 17 of the UK GDPR. Upon a valid erasure request, we will delete the personal data associated with your submission. Patterns that have been successfully anonymised and incorporated into the aggregated public knowledge base — where they no longer constitute personal data within the meaning of Recital 26 of the UK GDPR — may be retained indefinitely as part of the core Service. The continued retention of genuinely anonymised patterns does not constitute processing of your personal data and is therefore not affected by an erasure request.

You represent and warrant that your Submitted Content does not infringe third-party intellectual property rights, does not contain personal data of other individuals without their consent, and does not violate applicable law.

5.3 Third-Party Sourced Patterns

Patterns sourced by mistaike.ai from public repositories (e.g., GitHub, Stack Overflow) are processed in accordance with their original open-source licences or public domain status. These are not linked to mistaike.ai user accounts.

6. Subscription and Billing

mistaike.ai offers both free and paid subscription tiers. Paid plans provide enhanced features and higher usage limits as detailed on our pricing page.

6.1 Payment Processing

All payments are processed securely via Stripe, Inc. We do not store your full payment card details. Stripe processes payment data as an independent data controller; please refer to our Privacy Policy for details of the transfer mechanism governing data shared with Stripe.

6.2 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless cancelled before the renewal date.

6.3 Cancellation

You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of your current paid billing period. You will retain access to paid features until the period ends.

6.4 Refunds and Consumer Rights

If you are a consumer (an individual not purchasing for business purposes), you have statutory rights under the Consumer Rights Act 2015 that cannot be excluded or limited by this Agreement, including:

- Right to Reject (first 30 days): Within 30 days of purchasing a paid subscription, you may request a full refund if the Service is not of satisfactory quality, not as described, or not fit for purpose.

- After 30 days: If the Service fails to meet statutory quality standards, please contact us. If we cannot remedy the issue within a reasonable time, you may be entitled to a price reduction or compensation.

For business subscribers, all payments are non-refundable except where expressly required by applicable law.

This clause does not affect your statutory rights.

6.5 Price Changes

We may change our subscription prices with a minimum of 30 days' written notice by email. Your continued use of the Service after the price change takes effect constitutes your agreement to the new rate. If you do not agree to the new price, you may cancel before the change takes effect.

7. Vault Feature — Critical Disclaimer

> IMPORTANT WARNING — READ CAREFULLY BEFORE USING THE VAULT

The mistaike.ai Vault feature uses client-side encryption. Data placed in the Vault is encrypted on your device using a master password that only you know, before it is transmitted to our servers. This is a zero-knowledge architecture.

What this means:

- Zero access: mistaike.ai has ZERO access to the contents of your Vault. We do not store, transmit, or ever possess your plain-text master password or any unencrypted Vault content. Encryption and decryption occur solely on your device.

- No recovery: IF YOU LOSE OR FORGET YOUR MASTER PASSWORD, YOUR VAULT DATA IS PERMANENTLY AND IRRECOVERABLY LOST. We cannot reset your master password, decrypt your data, or recover your Vault under any circumstances whatsoever.

- Your responsibility: By activating the Vault feature, you acknowledge that you have read and understood this warning, and you accept full responsibility for securely managing and backing up your master password. We strongly recommend using a reputable password manager to store your Vault master password.

- On account deletion: Your encrypted Vault data is deleted from our servers immediately and irrecoverably when your account is terminated. This satisfies any erasure request under Art. 17 UK GDPR with respect to Vault content.

Before using the Vault, you will be asked to explicitly confirm you understand these terms via a tick-box acknowledgement. This is not a formality — it reflects a genuine technical limitation.

This disclaimer does not exclude liability for any failure of our systems to correctly implement the described zero-knowledge architecture. Your statutory rights are unaffected.

8. API and MCP Server Usage

Access to the mistaike.ai API and MCP server is subject to the following:

- Rate limits apply to all tiers as documented at mistaike.ai/docs/api. You must not attempt to circumvent rate limits by any means.

- API keys are personal to your account and must not be shared, published, or embedded in client-side code accessible to third parties.

- We reserve the right to throttle API access for accounts consuming disproportionate resources, with reasonable notice where practicable.

- We reserve the right to suspend or revoke API or MCP access where we have reasonable grounds to suspect abuse, breach of these Terms, or threat to platform security. For paid subscribers, we will endeavour to provide prior written notice and an opportunity to remedy the issue, except where immediate action is necessary to protect platform security.

9. Termination

9.1 Termination by You

You may terminate your account at any time via your account settings or by emailing [email protected]. Separately, you have the right to exercise your data erasure rights as described in our Privacy Policy, which you may do independently of terminating your account.

### 9.2 Termination by Us

We may suspend or terminate your access to the Service if:

- You commit a serious or intentional breach of these Terms (e.g., Acceptable Use violations involving security, abuse, or illegal activity) — immediate suspension may apply

- You commit a material breach of any other provision — we will provide 14 days' written notice and an opportunity to remedy the breach before termination

### 9.3 Effect of Termination — What Happens to Your Data

Upon termination (whether initiated by you or by us), the following applies to your personal data and your access to the Service:

- Access: Your right to access and use the Service ceases immediately upon termination.

- Account data: Standard account data (email address, password hash, TOTP secret, usage logs) will be permanently deleted within 30 days of termination, in accordance with our Privacy Policy retention schedules.

- Vault data: Your encrypted Vault data is deleted immediately and irrecoverably upon account termination.

- Submitted content: Submitted bug patterns will be immediately anonymised and disassociated from your account identifiers. The resulting anonymised patterns (which no longer constitute personal data) may remain in the public database as part of the core Service. If you wish to exercise your right to erasure under Article 17 of the UK GDPR with respect to any personal data within your submissions, please refer to our Privacy Policy for the process.

- Refunds: Prepaid but unused subscription fees for paid tiers will be refunded pro-rata for the unused period upon termination.

10. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

- Death or personal injury caused by our negligence

- Fraud or fraudulent misrepresentation

- Any breach of the terms implied by sections 16–18 of the Consumer Rights Act 2015 (satisfactory quality, correspondence with description, fitness for particular purpose of digital content) — for consumers only

- Any other liability that cannot lawfully be excluded under applicable law

Subject to the above, and to the maximum extent permitted by applicable law:

- mistaike.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, goodwill, or anticipated savings, even if we have been advised of the possibility of such damages.

- For business subscribers, our total aggregate liability arising under or in connection with these Terms shall not exceed the total fees paid by you to mistaike.ai in the 12 months preceding the event giving rise to the claim.

- For consumers, the above cap does not apply to claims arising from breach of the Consumer Rights Act 2015 implied terms; for other claims, we will work to resolve disputes fairly and in accordance with applicable law.

The reasonableness of these limitations is justified by the pricing of the Service and the nature of the informational content provided.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. The unenforceability of any provision will not affect the enforceability of the remaining provisions.

12. Governing Law and Data Protection

These Terms, and any disputes arising out of or related to them or the Service, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute.

In addition to the general law of England and Wales, you and mistaike.ai agree that the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 govern all processing of your personal data in connection with the Service. Nothing in these Terms derogates from any rights you hold as a data subject under the UK GDPR.

For consumers resident outside England and Wales, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

13. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email or a prominent notice on the platform before the new Terms take effect. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree, you must stop using the Service and may terminate your account.
